TERMS AND CONDITIONS

Understanding Your Rights, Responsibilities, and Our Commitment

Welcome to the Museum of Music & Entertainment in New York City (MOMENT). These Terms and Conditions govern your access to and use of our website, programs, services, events, and physical museum spaces. By visiting our website, participating in any of our programs, attending events, volunteering, or engaging with MOMENT in any way, you agree to comply with and be bound by these Terms and Conditions. We encourage all visitors, participants, families, volunteers, donors, and community members to read this document carefully to understand your rights, responsibilities, and the scope of our services.

Acceptance of Terms
By accessing MOMENT’s website, enrolling in programs, attending events, or using any services provided by the museum, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. If you do not agree to these terms in full, you are not permitted to use our website, attend programs, or participate in any MOMENT services. MOMENT reserves the right to update, revise, or amend these terms at any time without prior notice. Continued use of our services or website after any changes constitutes acceptance of the updated Terms and Conditions.

Eligibility
Participation in MOMENT’s programs and access to certain services is subject to eligibility criteria. Typically, our programs are designed for children from infancy through early school-age years. Enrollment for each program requires that participants meet age requirements and any prerequisites as outlined in program descriptions. Volunteers, staff, and community partners are required to meet age, background check, and qualification criteria appropriate to their roles. MOMENT reserves the right to deny participation to any individual who does not meet eligibility standards or who may pose a risk to the safety and well-being of other participants.

Enrollment and Registration
Enrollment in MOMENT programs is completed through our official registration channels, either online or in person. Parents and guardians must provide accurate and complete information for their children, including emergency contacts, health information, allergies, dietary needs, and any special accommodations required. Incomplete, inaccurate, or misleading information may result in the denial of enrollment. Enrollment is subject to availability, and MOMENT reserves the right to limit participation or close registration to ensure quality programming, appropriate adult-to-child ratios, and adherence to safety protocols.

Payment and Refund Policy
Program fees, workshop charges, donations, and other payments must be made in full at the time of registration or according to the payment schedule specified. MOMENT accepts payments via credit card, debit card, bank transfer, and other authorized methods. All financial transactions are processed securely, and MOMENT is not responsible for errors or delays caused by payment processors or financial institutions. Refunds may be issued under specific circumstances, including program cancellations initiated by MOMENT, medical emergencies requiring documentation, or other cases determined by the museum. Requests for refunds must be submitted in writing and are subject to approval. Program fees are generally non-refundable for voluntary withdrawals unless otherwise specified in the program details.

Health and Safety
The safety and well-being of all participants, visitors, staff, and volunteers is our highest priority. MOMENT implements strict health and safety protocols, including sanitization of instruments and surfaces, supervision ratios, emergency procedures, and staff training in first aid and child protection. Parents and guardians are required to provide accurate health and medical information and to inform MOMENT of any changes that may affect a child’s participation. MOMENT reserves the right to remove or refuse participation to any individual whose behavior, health condition, or actions pose a risk to themselves or others. In case of illness or medical emergency, MOMENT staff may provide first aid and contact emergency services as necessary.

Code of Conduct
All visitors, participants, volunteers, and staff are expected to behave respectfully and follow the museum’s code of conduct. This includes treating others with kindness and respect, following instructions from staff and educators, respecting museum property, exhibits, and instruments, and adhering to safety rules during all activities and events. Failure to comply with the code of conduct may result in removal from programs, events, or museum premises without refund. Repeated violations may result in suspension or permanent exclusion from participation in MOMENT programs.

Program Modifications
MOMENT reserves the right to modify, reschedule, or cancel programs, workshops, and events at its discretion. Such modifications may occur due to unforeseen circumstances, weather events, staffing constraints, or operational requirements. Participants will be notified of changes in a timely manner, and MOMENT will make reasonable efforts to provide alternatives, including rescheduling, credit for future programs, or partial refunds, as appropriate.

By attending, participants agree to allow the use of media for promotional or educational purposes unless a written objection is submitted. Images may appear on social media, websites, marketing materials, and printed publications.

Third-Party Services
MOMENT may use third-party vendors for payment processing, digital communications, or event management. These vendors are required to protect personal information and adhere to privacy and security standards. MOMENT is not liable for breaches or errors caused by third-party services but strives to work with trusted partners.

Program Cancellations and Weather Policies
In cases of inclement weather, natural disasters, or unforeseen emergencies, MOMENT reserves the right to cancel or reschedule programs. Reasonable efforts will be made to notify participants in advance, and alternatives such as make-up sessions, credits, or refunds may be provided.

Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of the State of New York, USA. Any disputes arising from participation in programs, use of services, or engagement with MOMENT must first be addressed through direct communication with the museum. If resolution cannot be achieved, disputes may be resolved through mediation or arbitration in New York City, as permitted by law.

Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. Invalidity of one section does not affect the validity or enforceability of other provisions.
